Terms of Service

These Terms of Service ("Terms") are an agreement between MAGICAI LTD, a company registered in Israel ("Commagic", "we", "us"), and the business that uses Commagic Chat ("you"). By creating an account, installing the WordPress plugin or the Wix app, or using the Service, you agree to these Terms. If you use the Service for an organisation, you confirm that you may bind it to these Terms.
1. The Service
Commagic Chat lets businesses add an AI chat assistant to their websites, turn website form entries and conversations into leads, follow up by WhatsApp, SMS, phone and voice calls, and connect calendars and job-management software. It works through the Commagic dashboard, the Commagic Chat WordPress plugin and the Commagic Chat Wix app (together, the "Service").
The Service is for businesses, not for personal or household use.
2. Accounts
- You must give accurate information when you sign up and keep it up to date.
- You are responsible for your account's sign-in details, for connection codes you generate, and for everything done under your account.
- Tell us at [email protected] straight away if you think your account has been misused.
3. Acceptable use
You must not use the Service to:
- send spam or unsolicited messages, or message or call anyone without the consent and lawful basis required by applicable law (including laws on SMS, WhatsApp, telemarketing and call recording);
- message anyone who has opted out (the Service records STOP replies, and you must honour them);
- break the law, infringe anyone's rights, or deceive people, including by hiding that they are talking to an AI assistant where the law requires you to say so;
- send malware, probe or overload the Service, or try to get around its limits or security;
- resell the Service or use it to build a competing product without our written permission.
4. Your data
You own the data you and your website visitors and customers put into the Service ("Customer Data"). You give us permission to process Customer Data to provide, secure and support the Service. We process personal information in Customer Data on your behalf as described in our Privacy Policy.
You are responsible for having a lawful basis for the Customer Data you collect, for giving your visitors and customers a privacy notice, and for obtaining the consents you need.
5. Third-party platforms
The Service connects to platforms run by others, such as WordPress, Wix, WhatsApp, Twilio, Google Calendar, Outlook, Jobber, Housecall Pro and Workiz. Your use of those platforms is governed by their own terms and policies, and we are not responsible for them. A feature that relies on a third-party platform may stop working if that platform changes or withdraws access.
6. AI output
The assistant's replies, summaries, transcripts and other output are generated by AI and may be inaccurate, incomplete or inappropriate. You are responsible for the instructions and information you give the assistant, for reviewing its output, and for any decision or commitment made to your customers. Do not rely on the output as professional advice.
7. Fees
The Service is currently free of charge. We may introduce paid plans in the future; we will give you notice before any charge applies, and you will not be charged without agreeing to it. Charges from third parties that you contract with directly (for example your own telephony or messaging provider) are your responsibility.
8. Availability and changes
The Service is provided "as is" and "as available". We work to keep it running but do not promise it will be uninterrupted or error-free. We may change, add or remove features. To the extent the law allows, we disclaim all implied warranties, including of merchantability, fitness for a particular purpose and non-infringement.
9. Suspension and termination
- You can stop using the Service at any time: disconnect the WordPress plugin or the Wix app and ask us to close your account.
- We may suspend or end your access if you break these Terms, if your use puts the Service, other customers or the public at risk, or if the law requires it. Where reasonable, we will tell you first.
- After termination, Customer Data is handled as described in the Privacy Policy: you can export your leads from the dashboard while your account is open, and records are kept only where the law requires.
10. Limitation of liability
To the extent the law allows, Commagic is not liable for indirect or consequential loss, such as loss of profit, business or opportunity, or for loss caused by the information you provided, by a third-party platform, or by events beyond our reasonable control. Commagic's total liability to you in connection with the Service is limited to the fees you paid Commagic in the twelve months before the claim arose, or 1,000 Israeli new shekels if no fee was paid.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or for deliberate harm.
11. Governing law
These Terms are governed by the law of Israel, without regard to its conflict-of-laws rules. The competent courts in Tel Aviv-Yafo have exclusive jurisdiction over any dispute arising from them, although Commagic may also seek urgent relief in any competent court.
12. Changes to these Terms
We may update these Terms. We will post the new version on this page with a new date and, for material changes, tell you by email or in the dashboard before they take effect. If you keep using the Service after that, the new Terms apply.
